Curtis Represents German Insolvency Administrator for Pickenpack Europe

Curtis is representing Friedrich von Kaltenborn-Stachau in his capacity as Insolvency Administrator to Pickenpack Production Lüneburg GmbH, Pickenpack Europe GmbH, Pickenpack Holding Germany GmbH and TST The Seafood Traders GmbH (collectively, the “Pickenpack Entities”).

The Pickenpack Entities are currently in insolvency proceedings pending in the Local Court of Lüneburg, Germany under the German Insolvency Act (the “German Proceedings”).  Prior to the German Proceedings, the Pickenpack Entities were in the business of the production and processing of various fish products.  Specifically, the Pickenpack Entities processed and sold deep-frozen fish consumer products for large retail chains in Germany and other European countries.

On September 22, 2016, Curtis commenced Chapter 15 cases for the Pickenpack entities, seeking formal recognition of the German Proceedings in the U.S.  The Chapter 15 cases of the Pickenpack Entities are pending in the United States Bankruptcy Court for the Southern District of New York before Judge James L. Garrity, Jr.

In addition to the Chapter 15 cases, Curtis is providing legal counsel in connection with the Pickenpack Entities pursuing claims in the Chapter 11 and Chapter 15 cases of China Fishery Group Limited (Cayman), and its various affiliates (collectively, “China Fishery”).  China Fishery is one of the world’s largest producers of fishmeal and fish oil and operates in emerging markets such as China, Peru, Russia, and certain countries in Africa.  The China Fishery Chapter 11 and Chapter 15 cases are also pending in the United States Bankruptcy Court for the Southern District of New York before Judge James L. Garrity Jr.

The Curtis team working on this engagement includes Restructuring and Insolvency Partner L. P. Harrison 3rd, Litigation Partner Turner P. Smith and Restructuring, Insolvency Associate Peter J. Buenger and Corporate Associates Kim Rissel and Dmitrij Kalaschnikow.
