The program will explore difficulties that arise for States at all stages of the arbitral process, from responding to the request for arbitration to selecting arbitrators, organizing the State’s defense and allocating resources, identifying relevant documentation and witnesses, and securing approval from relevant State authorities. Since the Court of Justice of the European Union rendered the Achmea judgment in March 2018, arbitral tribunals have nevertheless continued to find that they have jurisdiction over intra-EU investment disputes under BITs and the ECT. This webinar will discuss the intra-EU objection from the point of view of States and the European Commission.
