Curtis Represents Tecnoglass in Securing Negative ITC Injury Determination, Terminating AD Import Duties on Aluminum Extrusions from Colombia and 13 Other Countries

The U.S. International Trade Commission (ITC) has issued a negative determination in its final injury investigation on aluminum extrusion imports from Colombia and 13 other countries, including China, India, and Mexico. The Commission determined that imports from these countries, including Colombia, do not cause material injury or threaten the U.S. aluminum industry. This outcome is particularly notable, as negative injury determinations are highly unusual.

Curtis is proud to have represented Tecnoglass, a leading manufacturer of architectural glass, windows and doors, and the top Colombian exporter of aluminum extrusions into the U.S. We provided extensive and critical support to Tecnoglass throughout both the U.S. Department of Commerce (DOC) and ITC phases of the investigation.

Curtis’s representation involved helping Tecnoglass compile comprehensive sale and cost data in order to answer DOC and ITC questionnaires and making legal arguments in support of Colombian exporters. The Curtis team effectively advocated for a proper valuation of the nature and content of Colombian U.S. exports during the injury phase of the investigation to demonstrate that Colombian exports could not be considered as causing harm to U.S. aluminum extrusion producers.

The ITC’s decision represents a significant victory not just for Tecnoglass but for all Colombian companies, which retain their ability to continue exporting into the U.S. market without trade barriers. It also underscores the effectiveness of Curtis’s strategic representation and our commitment to supporting our clients through highly complex trade remedy cases.
