With an emphasis on Latin America, Eloy Barbará de Parres has practiced professionally for over thirty years in the areas of project finance, particularly in infrastructure development, and international arbitration, particularly in the energy sector. In addition, Mr. Barbará has experience in oil field development, corporate transactions, privatizations and international joint ventures. His practice focuses on large-scale projects in the energy industry, including projects for the generation of electric power and the exploration and exploitation of hydrocarbons under various contracting modalities such as independent power producers, service contracts, lease contracts, construction contracts and exploration and production contracts.
Mr. Barbará has extensive experience in the energy and natural resources sectors, where he has advised governments and state entities in the drafting, structuring and negotiation of petroleum contracts, including the exploration, evaluation and development of oil and gas fields, as well as energy production and distribution agreements.
He has advised on the development of contracts for the construction and operation of infrastructure, including, for example, one of the world's largest nitrogen plants, as well as refining facilities, electrical substations, transmission lines, power plants, gas pipelines, and coal and gasoline storage facilities. He was actively involved in a multi-billion dollar plan for the modernization of five refineries in Mexico, the increase of more than 4,000 MW of power generation capacity, and a program to increase production capacity in the Cantarell and Ku-Maloob-Zaap oil fields in Mexico. He has participated in the drafting and negotiation of oil and gas risk contracts in Latin America. Recently, he has advised Petrobras in the development of the Buzios oil field in Brazil.
Mr. Barbará has more than two decades of experience representing sovereign states and state-owned entities in major international litigation, including high-profile investor-state arbitrations in the oil and gas sector. He has represented sovereign clients in proceedings in English and Spanish conducted under the rules of the International Centre for Settlement of Investment Disputes (ICSID), the United Nations Commission on International Trade Law (UNCITRAL), the International Chamber of Commerce (ICC) and the London Court of International Arbitration (LCIA).
Mr. Barbará also assists state-owned entities in structuring major project finance transactions, and has drafted and negotiated contract documents, as well as conducted international bidding processes, in several of the largest transactions in Latin America in recent years. He also advises on supply contracts which form the basis of project finance transactions, as well as on other project documents, including engineering, procurement and construction contracts.
Prior to joining Curtis, Mallet-Prevost, Colt & Mosle LLP, Mr. Barbará was legal advisor to the Ministry of Finance and Public Credit in Mexico, where he participated in the review, negotiation and registration of loan agreements and other documents involving state-owned companies and banks, as well as the Federal Government of the United Mexican States.
