Seasoned international arbitration lawyer Mark O’Donoghue represents governments and sovereign states in international arbitrations and corporate transactions.
Mr. O’Donoghue has represented governments and private sector entities in arbitrations conducted in the United States and abroad under the auspices of the International Centre for Settlement of Investment Disputes (ICSID), the Stockholm Chamber of Commerce (SCC), the International Chamber of Commerce (ICC) and United Nations Commission on International Trade Law (UNCITRAL) rules. He maintains a strong focus on corporate and infrastructure matters.
Recent highlights of a stellar career include successfully defending the Republic of Cyprus in 2019 against a US$1.4 billion treaty claim brought by the owners of a bank placed into resolution. He also secured a victory for the Republic of Indonesia in 2019, when an ICSID annulment committee denied a request by Churchill Mining Plc and Planet Mining Pty Ltd for annulment of a 2016 Award, which saw the mining companies’ US$1.31 billion claims against the Republic of Indonesia dismissed as inadmissible, with costs and expenses in the underlying arbitration awarded to the state in the amount of US$9.4 million.
Mr. O’Donoghue’s litigation experience includes criminal and regulatory matters, as well as civil litigation of securities, tax, professional liability, joint venture and real estate disputes. As a corporate lawyer, he has represented state-owned and private companies in international energy and oil and gas infrastructure projects and has advised on mergers and acquisitions in the U.S. and Latin America.
Since 1999 Mr. O'Donoghue has acted as Chairman of Senator Charles E. Schumer’s Judicial Screening Panel. Prior to joining Curtis, he clerked for the Honorable Morris Pashman of the New Jersey Supreme Court.
Mr. O’Donoghue serves as Chairman of the Board of Directors of The Fedcap Group, Inc., a nonprofit social services agency headquartered in New York City.
