Dividing his time between Geneva and Washington, Matthew McCullough is well known for his work in U.S. trade remedy actions addressing dumping, subsidization and industry adjustment (safeguards), as well as the international agreements governing such actions.
Mr. McCullough advises governments and companies, both foreign and domestic, on an array of trade matters affecting cross-border trade in goods and services. He has represented the governments of Argentina, Brazil, Canada, China, Korea, Japan, Oman, and Vietnam in matters before U.S. agencies, and has represented many of the same governments in dispute settlement before the World Trade Organization (WTO). He also has experience with “Buy American” government procurement preferences, customs matters, issues related to export controls, anti-boycott regulations and the US sanctions regime. He represents clients from across the globe in the manufacturing and agriculture sectors and is often consulted on matters involving the domestic and global steel industries where he has written extensively U.S. protectionism in that industry.
Major recent matters on which Mr. McCullough has worked include representing the Government of Canada in a U.S. countervailing duty case brought against Canadian aircraft, fabricated structural steel, and wind towers, acting for the Government of New Brunswick in a countervailing duty case brought against Canadian softwood lumber, advising the Government of Newfoundland and Labrador in a countervailing case brought against uncoated groundwood paper, and appearing for the entire Spanish table olive industry in both injury and AD/CVD proceedings involving imports of ripe olives. He was also part of the litigation team that won a ruling from the U.S. Court of Appeals for the Federal Circuit, invalidating the use of the U.S. countervailing duty law against China while China is treated as a non-market economy for antidumping law purposes.
